RD22 (2019) Bullying, discrimination and sexual harassment

 

Notifiable conduct:

(Section 140, Australian Health Practitioner Regulation National Law Act 2009)

·        Sexual misconduct – towards a patient or colleague

·        Jeopardising patients due to an impairment

·        Jeopardising patients due to intoxication

·        Jeopardising patients due to significant departure from accepted professional standards of practice

 

Definitions:

Bullying

·      Repeated unreasonable behaviour directed towards a person, creating a risk to health and safety

Discrimination

·      Where a person, or group of people is treated less favourably than another person or group because of race / sex / pregnancy / family responsibilities / breastfeeding / age / sexual orientation / gender identity / intersex status

Sexual harassment

·      Conduct of a sexual nature which offends, humiliates or intimidates the person towards whom it is directed, regardless of intent

 

What to do if subject to the above:

Gather evidence

·      Document objective facts

Seek advice

·      Peer

·      Mentor

·      SOT

Make it stop

·      Address the alleged offender if you feel you can

·      Supervisor

·      Hospital HR
